Electric Bicycle Release and Liability Waiver

The company/organization representative, listed below, has made a voluntary request to lease an electric powered bicycle from the Association of Monterey Bay Area Governments (AMBAG). The company/organization acknowledges that at no time will they or anyone in the company/organization be in the employ of AMBAG.

No promise has been made to the company/organization at any time they will be protected by AMBAG or any of its officers, agents, or employees from any actions of other parties while we are participating in the Electric Bicycle Loan Program. The company/organization is aware that riding a bicycle (electric or not) on public streets is inherently danger-ous, and that we may be subjected to the risk of death, personal injury, or damage to property during the above stated period. The company/organization acknowledges freely, voluntarily, and with the above knowledge assume the risk of death, personal injury, or property damage while participating in the Electric Bicycle Loan Program.

The company/organization has received, reviewed, and understands fully all of the rules and regulations of the Electric Bicycle Loan Program currently in effect. They agree to comply with all of the rules and regulations of the Electric Bicycle Loan Program and the Department of Motor Vehicles requirements.

The company/organization agrees that AMBAG and all employees, officials, agents, representatives, shall NOT be responsible or liable for any injury, damage, loss, or expense to person/company/organization and/or property, incurred while riding on an electric bicycle assigned to the company/organization by AMBAG.

The company/organization, executors, administrators, and assigns, agree to defend and indemnify AMBAG and all employees, officials, agents, representatives, and sureties of AMBAG, and each of them against any and all claims, suits, causes of action, debts, demands, injuries, damages and liabilities arising from riding on an electric bicycle as a volunteer participant for this Electric Bicycle Loan Program.

The company/organization has carefully read and understands the contents of this document and signs the same of their own free will. Anyone from the company/ organization that rides the electric bicycle must be at least eighteen (18) years old, have presented a valid California Drivers License, be in good physical condition, and agree to wear a D.O.T. approved bicycle helmet at all times when riding the electric bicycle, and have voluntarily executed an Electric Bicycle Release and Liability Waiver. They also agree to read and familiarize themselves with Vehicle Code Section Nos., 24016/21200/21200.5 and 21212 and to adhere to those State of California DMV guidelines established for electric bicycles. They also agree to adhere to the rules of the road in the Vehicle Code as pertains to bicycles on public roads and highways.
